The franchisor is offering franchises for quick service restaurants which feature pizza, pasta and other Italian food items. The Restaurants are generally located within enclosed regional shopping malls, airports, hospitals, cafeterias, commissaries, schools, hotels and stadiums, arenas, ballparks, festivals, fairs and other mass gathering locations or events, and the premises of certain customers with corporate campus or institutional feeding sites that have an agreement with the Franchisor to place a “Famous Famiglia” Restaurant in more than one of their facilities with a captive market customer base.

The Franchise Agreement grants the franchisee the right to operate a “Famous Familglia” Restaurant at a single location that the franchisee selects within the Assigned Area and is approved by the franchisor. The franchisee must operate the Restaurant only at this location and may not relocate the Restaurant without written consent from the franchisor. The franchisee may not establish or operate another restaurant unless the franchisee enters into a separate Franchise Agreement. The offering is generally for a Restaurant of approximately 400 to 800 square feet located in a food court, or 1,500 to 2,000 square feet if located in an in-line space, in shopping malls with approximately 800,000 square feet or more. Generally, Famous Famiglia sites will not vary significantly from the food–court or in-line prototypes described, however, the franchisor may consider other locations on a case-by- case basis.

Famiglia International, Inc. was incorporated as a New York Corporation on June 2, 2000. The Company does not have any predecessors or affiliates. The Restaurants operate under the service mark “Famous Famiglia” and the additional principal service marks, trademarks, trade names, logos, emblems and indicia of origin. The franchisor does not own any locations of the type being franchised, but they have formed separate subsidiary corporations which own and operate four Restaurants, three of which are located in the New York metropolitan area and one is located in Ann Arbor, Michigan. In addition, the franchisors principals, Paul and John Kolaj, together with a select number of employees, own and operate seven additional Restaurants located in Manhattan, New York. The franchisor has never offered franchises in any other line of business.
